The Financial Times has published an in-depth piece on the return of the “Italian Torpedo”, a term coined in 1997 by Prof. Mario Franzosi, now Of Counsel at our Firm.
The expression refers to a procedural strategy that involves pre-emptively initiating legal proceedings in a jurisdiction known for its lengthy timelines – such as Italy – in order to hinder or delay parallel actions in other jurisdictions.
Today, post-Brexit, the term has regained relevance: the removal of the binding effect of EU rules has reopened the door to using this tactic in cross-border disputes.
