The Firm’s success in defending a FacilityLive director in a €6 Million+ dispute
Our Firm successfully represented a director of FacilityLive, a leading technology company based in the Pavia area (Lombardy), in complex corporate litigation brought by one of its shareholders.
The claim sought damages in excess of €6 million, alleging liability on the part of several directors who had served in the company’s management over the years.
The Milan Court fully upheld the defence strategy developed by the Firm’s litigation team, ruling out any liability of the client and dismissing all claims in their entirety.
The case involved particularly complex issues relating to corporate governance, directors’ duties and liability, and the assessment of managerial decisions in the context of a highly innovative business.
The client was assisted by a team led by our Senior Partner Alberto Di Alberto, together with the lawyers Chiara Tosseri and Giuseppe Di Mauro.
The decision highlights the importance of highly specialised expertise in corporate litigation, an area in which the Firm regularly advises companies, directors, shareholders, and investors, both in the ordinary course of business and in dispute scenarios.
FacilityLive operates in the development of software and hardware platforms and notably developed the official app for the G7 Summit in Taormina. The company has been recognised among "Europe’s Unicorns" by the European Commission and was the first non-UK company admitted to the London Stock Exchange’s ELITE Programme.
